OVERVIEW

Welcome to IMMUNE. The terms "we," "us," and "our" refer to IMMUNE and Jeremiah Moore, doing business as IMMUNE. IMMUNE operates this store and website, including its content, features, tools, products, and services, to provide a curated streetwear and fitness apparel shopping experience (the "Services"). The Services are powered by Shopify.

These Terms of Service, together with the policies referenced here, describe your rights and responsibilities when using the Services. They include important information about purchases, disclaimers, and limitations of liability.

By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy at https://immunebrands.shop/policies/privacy-policy. If you do not agree, do not use the Services. Nothing in these Terms limits rights that cannot lawfully be excluded.

By using the Services, you represent that you are at least the age of majority in your jurisdiction or that a parent or legal guardian has authorized your use. You must provide current, complete, and accurate information when asked, including billing, payment, and shipping information.

You are responsible for keeping account credentials confidential and for activity under your account. Notify us promptly if you suspect unauthorized use. You may not sell, transfer, assign, or license your account.

SECTION 2 - OUR PRODUCTS

IMMUNE sells apparel including tees, tanks, and hoodies. We make reasonable efforts to display product descriptions, materials, color, sizing, fit, measurements, care information, and images accurately. Colors and appearance may vary because of screen settings, photography, garment washes, production batches, or normal manufacturing tolerances. Review the product page and size guide before ordering.

We may update descriptions, discontinue products, or limit quantities or availability by person, region, or jurisdiction, subject to applicable law. Nothing in these Terms excludes mandatory guarantees that products will be of acceptable or satisfactory quality, fit for disclosed purpose, and match their description where those guarantees apply.

SECTION 3 - ORDERS

Placing an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean acceptance. The order is accepted when we dispatch the goods. We may decline or cancel an order for legitimate reasons, including stock errors, suspected fraud, pricing errors, delivery restrictions, or breach of these Terms. If we cancel after payment, we will refund the amount paid.

Review your order carefully before submitting it. Contact shopstores009@gmail.com immediately if you request a change or cancellation; we cannot guarantee changes after processing begins. Returns and exchanges are governed by our Refund Policy at https://immunebrands.shop/policies/refund-policy. Products are sold for personal or household use unless we agree otherwise in writing.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price shown when the order is placed, subject to correction of an obvious error. Prices are displayed in the currency selected or shown at checkout. Product price, shipping charges, taxes, duties collected by us, and other applicable charges will be shown before payment.

You must provide accurate purchase and payment details and be authorized to use the selected payment method. Separate promotional terms apply where stated. If promotion terms conflict with these Terms, the promotion terms control for that promotion.

SECTION 5 - SHIPPING AND DELIVERY

Processing and delivery estimates are explained in our Shipping Policy at https://immunebrands.shop/policies/shipping-policy. Delivery dates are estimates unless we expressly agree otherwise or applicable law provides a deadline. Delays may occur because of carrier operations, customs, weather, incorrect details, holidays, or events outside our reasonable control. We will assist with delivery concerns and provide any remedy required by law.

Risk of loss and title pass at the time required by applicable law. For consumers in the EU/EEA and UK, risk generally passes when you or a person you nominate receives the goods, unless you independently arranged a carrier not offered by us.

SECTION 6 - INTELLECTUAL PROPERTY

The Services and their content—including the IMMUNE name and mark, BECOME IMMUNE, collection names and messages, apparel graphics, typography, photographs, videos, text, page layouts, and other brand elements—are owned by or licensed to IMMUNE and protected by applicable intellectual-property laws.

You may use the Services only for personal, non-commercial purposes. Without written permission, you must not copy, reproduce, distribute, modify, create derivative works from, publicly display, publish, download, store, transmit, or commercially exploit protected content. Shopify and third-party names and marks belong to their respective owners. All rights not expressly granted are reserved.

SECTION 7 - OPTIONAL TOOLS

We may provide access to optional third-party tools that we do not control. To the extent permitted by law, they are provided "as is" and "as available." Your use of a third-party tool is subject to the provider's terms and privacy notice. New features and tools added to the Services are also governed by these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain links or embedded functions provided by third parties. We do not control or guarantee their content, accuracy, availability, security, products, or practices. Review the third party's terms and policies before using its services or making a transaction. Nothing here excludes liability that cannot lawfully be excluded.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Shopify provides the e-commerce platform that powers the Services. Purchases from the IMMUNE store are made directly from Jeremiah Moore, doing business as IMMUNE, not Shopify. Shopify is not the seller of IMMUNE products and is not responsible for fulfillment, returns, refunds, product quality, or customer support, except to the extent Shopify separately states or applicable law requires.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled under our Privacy Policy at https://immunebrands.shop/policies/privacy-policy. Shopify also processes certain information under its own privacy notices. By using the Services, you acknowledge these privacy practices.

SECTION 11 - FEEDBACK

If you submit ideas, suggestions, reviews, photographs, comments, or other feedback ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, distribute, and display that Feedback to operate, improve, and promote the Services, subject to applicable privacy and consumer law.

You confirm that you own or have permission to submit the Feedback, have disclosed any incentive, and will not infringe rights, mislead others, or submit unlawful, abusive, obscene, defamatory, or malicious material. We may moderate or remove Feedback where permitted. This section does not transfer ownership of your Feedback to us or waive any moral rights that cannot be waived.

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, sizing, pricing, promotions, shipping charges, delivery estimates, or availability. We may correct or update information and, where lawful, cancel an affected order. If we cancel a paid order, we will refund it. We will not rely on this section to avoid obligations arising from misleading representations or mandatory consumer law.

SECTION 13 - PROHIBITED USES

You may use the Services only for lawful purposes. You must not use them to violate law or third-party rights; harass, threaten, defame, or harm anyone; transmit false or misleading information; send spam; impersonate another person; distribute malware; interfere with security; scrape or extract data without permission; circumvent access controls; or copy, resell, or exploit any part of the Services without authorization.

We may restrict, suspend, or terminate access where we reasonably believe these Terms have been violated or the Services, IMMUNE, customers, or others are at risk.

SECTION 14 - AGENTS

This section applies to software or services that act autonomously or semi-autonomously on behalf of a person or entity (an "Agent"). An Agent accessing the Services must identify itself accurately, comply with applicable law and these Terms, respect technical controls and published instructions, and must not conceal automation, mimic a human to evade safeguards, bypass CAPTCHAs, or circumvent restrictions. We may limit or block Agent access to protect the Services and customers.

SECTION 15 - TERMINATION

You may stop using the Services at any time. We may suspend or terminate access for breach, fraud, misuse, risk to others, legal requirements, or discontinuation of the Services. Termination does not affect rights and obligations already accrued, including payment obligations and statutory consumer rights. Provisions that by their nature should survive will remain effective, including intellectual property, feedback licenses, disclaimers, liability limits, indemnity, governing law, and privacy obligations.

TO THE FULLEST EXTENT PERMITTED BY LAW, AND EXCEPT FOR EXPRESS PROMISES OR MANDATORY RIGHTS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT PROMISE THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.

THIS DISCLAIMER DOES NOT EXCLUDE OR LIMIT ANY WARRANTY, GUARANTEE, CONDITION, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING RIGHTS UNDER EU OR MEMBER-STATE CONSUMER LAW, THE UK CONSUMER RIGHTS ACT 2015, APPLICABLE UNITED STATES OR CANADIAN CONSUMER LAW, OR THE AUSTRALIAN CONSUMER LAW.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IMMUNE, JEREMIAH MOORE, AND THEIR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL LOSS ARISING FROM THE SERVICES OR PRODUCTS WHERE SUCH LOSS WAS NOT REASONABLY FORESEEABLE.

NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, WILLFUL MISCONDUCT, BREACH OF NON-EXCLUDABLE CONSUMER GUARANTEES, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE LIMITED. WHERE A LIMIT IS PERMITTED, OUR TOTAL LIABILITY RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT PAID FOR THE AFFECTED ORDER, EXCEPT WHERE APPLICABLE LAW REQUIRES A DIFFERENT REMEDY.

SECTION 18 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify IMMUNE and Jeremiah Moore against third-party claims, losses, and reasonable legal costs arising from your unlawful use of the Services, material breach of these Terms, or infringement of another person's rights. This obligation does not apply to loss caused by our negligence, breach, or unlawful conduct, and does not limit mandatory consumer rights.

SECTION 19 - SEVERABILITY

If a provision of these Terms is unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

A failure to enforce a right is not a waiver of that right. These Terms and the policies incorporated by reference form the agreement governing the Services and supersede earlier communications about the same subject, except that they do not override rights, product information, or representations that cannot lawfully be excluded.

SECTION 21 - ASSIGNMENT

You may not assign these Terms without our prior written consent. We may assign them as part of a merger, sale, reorganization, or transfer of our business, provided this does not reduce mandatory rights. Any assignment remains subject to applicable law.

SECTION 22 - GOVERNING LAW

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules. Courts located in Maricopa County, Arizona will have jurisdiction, except where mandatory consumer law permits you to bring or defend a claim in your place of residence or requires another law or forum. Consumers in the EU/EEA, UK, United States, Canada, and Australia retain the protection of non-waivable laws that apply to them.

The current version of these Terms is available on this page. We may update the Terms for operational, legal, security, or regulatory reasons. The updated version will be posted with a revised date, and we will provide notice of material changes where required. Changes do not retroactively alter an accepted order unless lawfully agreed.
